Terms of Service

Please read these terms carefully before using FreightWatch.

Effective date: June 1, 2026

Acceptance of Terms

By accessing or using FreightWatch (freightwatch.ai), you agree to be bound by these Terms of Service. If you do not agree, do not use the service.

These terms apply to all users — including visitors who use the free search, registered account holders, and paid subscribers.

Description of Service

FreightWatch is a carrier intelligence platform that aggregates and displays publicly available FMCSA safety data on licensed motor carriers operating in the United States. Features include carrier search, authority and insurance status, safety ratings, inspection history, BASIC scores, watchlists, and email alerts.

FreightWatch is intended as a due-diligence research tool. It is not a substitute for legal advice, and using FreightWatch does not guarantee compliance with any federal, state, or local regulation.

Data Accuracy Disclaimer

All carrier data displayed on FreightWatch is sourced from FMCSA public datasets and is provided for informational purposes only. FreightWatch does not guarantee the accuracy, completeness, or timeliness of any data displayed.

FMCSA data can contain errors, omissions, or delays. Authority status, insurance records, and safety ratings can change between our daily sync and the moment you view them. Always verify critical information directly with FMCSA (li-public.fmcsa.dot.gov) before making hiring decisions.

FreightWatch is not affiliated with, endorsed by, or operated by the Federal Motor Carrier Safety Administration or the U.S. Department of Transportation.

No Legal Liability for Hiring Decisions

FreightWatch provides data to support your carrier vetting process. FreightWatch is not responsible for any loss, damage, accident, claim, or liability arising from your decision to hire, dispatch, or contract with any carrier — regardless of what data FreightWatch displayed at the time.

Carrier vetting is one component of a compliance program. FreightWatch does not provide legal advice and makes no representation that using FreightWatch satisfies any specific legal standard of due diligence.

Account Registration

You must provide a valid email address to create an account. You are responsible for maintaining the security of your account and for all activity that occurs under it.

You may not share account credentials with others. Each user must have their own account. Business plan subscribers may invite team members through the team management feature.

You must be at least 18 years old and have authority to bind your organization to these terms if registering on behalf of a business.

Subscriptions and Billing

FreightWatch offers a free tier and paid subscription plans (Pro and Business). Paid subscriptions are billed monthly in advance. Prices are listed on the pricing page and are subject to change with 30 days' notice.

All payments are processed by Stripe. By subscribing, you authorize FreightWatch to charge your payment method on a recurring basis until you cancel.

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — you retain access until then. No refunds are issued for partial billing periods.

FreightWatch reserves the right to suspend or terminate accounts with overdue balances.

Free Tier Limits

Free accounts may save up to 5 carriers to their watchlist. Additional saves require a Pro or Business subscription.

FreightWatch reserves the right to adjust free tier limits with reasonable notice.

Prohibited Uses

You may not use FreightWatch to scrape, bulk-download, or systematically extract carrier data for redistribution, resale, or to build a competing product.

You may not use automated bots, scripts, or crawlers to access FreightWatch without prior written authorization.

You may not use FreightWatch for any unlawful purpose, including discrimination in carrier selection based on protected characteristics.

You may not attempt to gain unauthorized access to any part of the FreightWatch system or another user's account.

Violation of these prohibitions may result in immediate account termination and, where appropriate, legal action.

Intellectual Property

The FreightWatch platform, including its design, code, features, and original content, is owned by FreightWatch and protected by copyright and other intellectual property laws.

FMCSA carrier data displayed on FreightWatch is sourced from U.S. government public domain datasets and is not owned by FreightWatch.

You may not reproduce, distribute, or create derivative works from FreightWatch content without prior written permission.

Limitation of Liability

To the maximum extent permitted by applicable law, FreightWatch and its owners, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — the service.

FreightWatch's total liability for any claim arising out of these terms or your use of the service shall not exceed the amount you paid to FreightWatch in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless FreightWatch and its owners, employees, and contractors from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the service, your violation of these terms, or your violation of any third-party rights.

Service Availability

FreightWatch strives for high availability but does not guarantee uninterrupted access. Scheduled maintenance, infrastructure outages, or third-party service failures may cause temporary unavailability. We will communicate planned downtime when feasible.

FreightWatch reserves the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice.

Governing Law

These Terms of Service are governed by the laws of the United States. Any disputes arising under these terms shall be resolved through binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property violations.

Changes to These Terms

We may update these Terms of Service from time to time. Material changes will be communicated by email or by a notice on the FreightWatch website. Continued use of the service after changes are posted constitutes acceptance of the updated terms.
